Morocco to Implement New Real Estate Proxy Law
Starting June 1, 2026, Morocco will enforce Law No. 31.18 pertaining to proxies related to real estate rights. This reform aims to enhance transparency in the real estate market and combat fraud and land dispossession.
A Strengthened Legal Framework for Real Estate Proxies
The new law mandates that any proxy relating to real estate rights must be established in an authentic format. It must be drafted by a notary, an adoul, or a lawyer accredited by the Court of Cassation, failing which it will be deemed null and void. This measure governs transactions involving the sale, purchase, management, or mortgage of real estate, aiming to reduce abuse and secure transactions.
A National Electronic Register for Increased Transparency
The reform includes the creation of a unified national electronic register dedicated to real estate proxies. This system will centralize documents, ensure their traceability, and reduce the risk of fraud. Courts and the National Land Conservation Agency (ANCFCC) are engaged to support the implementation of this system.
Major Changes for Real Estate Civil Companies (SCI)
Law 31.18 also introduces new obligations for SCIs. These entities will now be required to register and acquire legal personality. SCIs engaging in commercial activities regularly will be obliged to transform into commercial companies, with the objective of enhancing transparency and legal compliance.
A Reform Aimed at Combating Land Dispossession
This reform is part of ongoing royal initiatives aimed at strengthening the protection of property rights and combating networks of land dispossession, particularly affecting Moroccans living abroad (MRE).
Towards the Modernization of the Moroccan Land System
With this new law, Morocco is accelerating the digitization and security of its land system. The goal is to enhance the trust of citizens and investors and to modernize the management of real estate transactions.
